Music licensing is the licensed use of copyrighted music. Music licensing is intended to ensure that the owners of copyrights on musical works are compensated for certain uses of their work. A purchaser has limited rights to use the work without a separate agreement. The right, granted by the copyright holder or his/her agent, for the broadcast, recreation, or performance of a copyrighted work. Types of licensing contracts can include: 1) a flat fee for a defined period of usage, or 2) royalty payments determined by the number of copies of the work sold or the total revenues acquired as a result of its distribution. In addition to a basic fee, most music licensing agreements require additional payments to the copyright owner when the work in which it is included (movie, play) is financially successful above a certain threshold

The rights to a composition or the "song", which is different from the studio sound recording, are most often administered by the publishing company that represents the writer/producer. The value in the copyright of a recording is divided into two components:

  1. the "master" sound recording, which is the actual studio recording of the song and most often owned by the record label;
  2. the composition, which consists of the underlying lyrics and melody written by the songwriter and is typically administered by the music publisher.

When an audio/visual project producer wants to use a recording in their work, they must contact both the owner of the sound recording (record label), and the owner of the composition (songwriter via publishing company). In many cases, producers with tight budgets will elect to use a cover version of a particular song in order to save money on the master side. Once the producer has made an inquiry with the copyright administrator (and additionally the record label if they choose to use a famous recording), the rights holder or administrator issues a quote or NOI. This can initiate negotiations, whose points of interest usually include things like how the work is being used, the length of the segment, the prominence of the cue (whether used as background music, or as the title track during the credits), and the overall popularity and importance of the song or recording. Sync licensing fees can range anywhere from free, to a few hundred dollars, to tens of thousands of dollars for popular recordings of songs: in the last case, the producer must pay for both the use of the master and the composition.

In radio broadcasting, airplay is how frequently a song is being played on radio stations. A song which is being played several times every day (spins) would have a large amount of airplay. Music which became very popular on jukeboxes, in nightclubs and at discotheques between the 1940s and 1960s would also have airplay.

For commercial broadcasting, airplay is usually the result of being placed into rotation, also called adding it to the station's playlist by the music director, possibly as the result of a Pay for Play sponsored by the record label. For student radio and other community radio or indie radio stations, it is often the selection by each disc jockey, usually at the suggestion of a music director.

A necessary and important service provided by the publisher is that of proper administration of musical compositions: registering copyrights, filing necessary information to mechanical and performing rights organizations, auditing record companies and other licensees, bookkeeping, negotiating licenses, and collecting monies due. Considering the complexity of the music industry, the hundreds of thousands of music users throughout the world, the lack of detail on many royalty statements from licensees, and the amounts of money involved ($250,000 to $1 million is not unusual for a worldwide hit song), this service is vital.
